RURAL DEFINITION GRANDFATHERING PROVISION INCLUDED IN SENATE FARM BILL. This week the Senate is considering S. 954, which includes an extension of current area eligibility for USDA housing programs through the 2020 Census and raises the population limit of grandfathered places to 35,000. Communities up to 50,000 would become eligible for non-housing programs. H.R. 1947, the Farm Bill passed by the House Agriculture Committee on May 15, does not address these issues.

SECTION 538 MULTIFAMILY LOAN GUARANTEES AVAILABLE. Loans must be for new construction or acquisition and rehab of affordable rural rental housing. Approved applications from prior years will be funded first. Lenders may submit NOFA responses through December 31. Conditional commitments will be issued before September 30 until FY13 funds are expended. The NOFA will be published in the Federal Register on May 23 and on RD’s site. USDA WORKING TO COVER RENTAL ASSISTANCE SHORTFALL. USDA RD is taking steps to avoid displacing an estimated 15,000 tenants from 500-600 properties because of the anticipated gap in FY13 Section 521 RA funding (see HAC News, 5/1/13). An Unnumbered Letter issued May 1 requires all RA transfers to be approved by the national office rather than state offices. Contact Stephanie White, RD, 202-720-1615. RD will also use special servicing actions to enable owners to cover costs with reserve funds, defer mortgage payments temporarily, and the like, and will train employees over a four-week period starting in late May so that actions will be consistent nationwide.

RURAL HOUSING STABILITY ASSISTANCE PROGRAM COMMENT DEADLINE EXTENDED. Comments are now due July 1 on the RHSP proposed regulation published March 27, 2013 (see HAC News, 4/3/13). Comments on the definition of chronically homeless are still due May 28. Contact Ann Marie Oliva, HUD, 202-708-4300.

CFPB CONFIRMS ITS DEFINITION OF RURAL. Amendments issued on May 23, 2013 clarify how rural and underserved areas will be identified for Consumer Financial Protection Bureau mortgage-related regulations. The rural designation relies on the USDA Economic Research Service’s Urban Influence Codes. CFPB has posted a final list of rural and underserved counties for June-December, 2013. HUD PUBLISHES ANNUAL ADJUSTMENT FACTORS. FY13 AAFs are used to change rents on Section 8 contract anniversaries. Contact Michael S. Dennis, HUD, 202-708-1380.

HIGH HOMEOWNERSHIP RATES LEAD TO HIGHER UNEMPLOYMENT, RESEARCH FINDS. A working paper published by the Peterson Institute for International Economics reports that states with increases in homeownership experience increases in unemployment as much as five years later. The authors write that owners are not disproportionately unemployed, but the housing market can produce negative externalities upon the labor market. Ownership leads to less labor mobility, greater commuting times, and – perhaps because of NIMBY reactions or zoning restricttions – fewer new businesses. Does High Home-Ownership Impair the Labor Market? and a related New York Times op-ed are available online.

PEOPLE WITH DISABILITIES RECEIVING SSI CAN’T AFFORD HOUSING. Priced Out in 2012, a study by the Technical Assistance Collaborative and the Consortium for Citizens with Disabilities Housing Task Force, shows the national average rent for a modestly priced one-bedroom apartment is higher than the Supplemental Security Income payment of a person with a disability. TAC’s website offers data by metro areas and statewide nonmetro areas.

HUD INVITES TRIBES/TDHES TO PARTICIPATE IN ONLINE HOUSING NEEDS SURVEY. As part of its study of housing needs for Native Americans, Alaska Natives, and Native Hawaiians, HUD is conducting an invitation-only online survey of some tribes and Tribally Designated Housing Entities (researchers are visiting others). REGISTER NOW FOR TRAINING ON SECTION 502 LOAN PACKAGING. Join HAC June 18-20 in Knoxville, TN for “Section 502 Packaging Training for Nonprofit Developers” and learn how to assist potential borrowers and work in partnership with RD staff, other nonprofits, and regional intermediaries to deliver successful Section 502 loan packages. This course is intended for and specifically framed for those experienced in utilizing Section 502 and/or other affordable housing mortgage products. SEQUESTRATION, FUNDING CUTS TO IMPACT RURAL RENTAL ASSISTANCE AND RD EMPLOYEES. FY13 was discussed at two hearings on USDA’s FY14 budget request held in April by the House Appropriations Committee’s Agriculture Subcommittee. On April 16, USDA Secretary Tom Vilsack said that FY13 funding will fall short for 15,000 RA households while the $1.015 billion requested by the Administration would allow renewal of all expiring contracts in FY14. In response to questioning, he also stated that RD and Farm Service Agency employees could be furloughed for up to ten days. On April 24, responding to a question, Acting Under Secretary for RD Doug O’Brien said the FY14 budget did not include enough RA funding to make up for the FY13 shortfall. Rep. Sam Farr (D-CA) asked why USDA does not work through housing authorities in places where they exist, and expressed frustration at delays in issuing regulations that would allow nonprofits to package loan applications.

REP. MEL WATT NOMINATED TO HEAD FHFA. On May 1 President Obama nominated Rep. Melvin Watt (D-NC) as director of the Federal Housing Finance Agency. Watt has been a member of Congress since 1992 and a member of the Financial Services Committee, which oversees housing programs.

SENATE BILL WOULD CONTINUE AREA ELIGIBILITY FOR RURAL HOUSING PROGRAMS. S. 766, introduced April 18 by Sen. Tim Johnson (D-SD), is similar to H.R. 858, which was introduced February 27 (see HAC News, 3/6/13) by Rep. Jeff Fortenberry (R-NE). Both would revise the rural housing programs’ definition of “rural” to extend grandfathering of currently eligible places through the 2020 Census. The House bill would retain current law ending grandfathering if a place reaches 25,000 population; the Senate bill would increase that limit to 35,000.

HUD TO CLOSE AND CONSOLIDATE SOME FIELD OFFICES. Sixteen of HUD’s 80 field offices will close by early FY14, leaving at least one HUD office in each state. HUD’s Office of Multifamily Housing Programs will consolidate 50 offices into five Multifamily Hubs and five satellite offices by the end of 2015. Positions and workloads will be changed as well. Affected employees will be offered early retirements, buyouts, or relocation.

CFPB PROPOSES AMENDMENTS TO SOME FINAL MORTGAGE RULES. On May 2 the Consumer Financial Protection Bureau will propose changes to Real Estate Settlement Procedure Act and Truth In Lending Act regulations finalized in January 2013. The amendments relate to state laws, the small servicer exemption from certain servicing rules, and Qualified Mortgages. Comments will be due in 30 days. Contact Whitney Patross, CFPB, 202-435-7700.

FAIR HOUSING GUIDANCE ADDRESSES DESIGN AND CONSTRUCTION, ASSISTANCE ANIMALS. The Departments of Justice and HUD have released new guidance on the Fair Housing Act’s requirements for design and construction of multifamily housing. HUD also issued a notice reaffirming that housing providers must make reasonable accommodations for people with assistance animals. Contacting HUD’s Fair Housing Office, 800-669-9777.

USDA RD, OTHERS WILL CONTINUE EFFORTS TO ADDRESS INDIAN COUNTRY WATER/WASTEWATER NEEDS. A new Memorandum of Understanding among EPA, HHS, HUD, the Department of the Interior, and USDA agrees to continue federal coordination in delivering water infrastructure, wastewater infrastructure and solid waste management services to tribal communities. OGLALA SIOUX “TAKE THE RESERVATION TO WASHINGTON.” In April, the Trail of Hope for Indian Housing initiative trucked the façade of an aging, overcrowded house from Pine Ridge, SD to Washington, DC and held a rally near the U.S. Capitol to show Congress the state of Indian housing in tribal communities.

MARKET IMPACT OF CHANGING MORTGAGE INTEREST DEDUCTION NOT CLEAR, UI REPORTS.How Would Reforming the Mortgage Interest Deduction Affect the Housing Market?”summarizes past research and a roundtable hosted by the Urban Institute. It concludes that “the best available evidence predicts far less dire effects [than some forecasts anticipate], and some reforms to the MID could actually bolster the housing market recovery.” UI plans to conduct additional research.

2013 ADVOCATES’ GUIDE TO HOUSING AND COMMUNITY DEVELOPMENT POLICY AVAILABLE. The National Low Income Housing Coalition’s annual guide covers programs and policies and provides advocacy tools. It is free online or can be ordered from Christina Sin, NLIHC, christina@nlihc.org, 202-662-1530 ext. 224.

USDA RURAL HOUSING BUDGET EMPHASIZES LOAN GUARANTEES. In the Obama Administration’s budget request for FY14, released on April 10, the Section 502 and 538 guarantee programs remain the focus of rural housing provision. Section 502 direct would fall from $900 million this year to only $360 million in FY14, and Section 515 from $31.3 million to $28.4 million. Increased funding is requested for Section 521 Rental Assistance, but data are not available for those outside USDA to calculate whether the higher amount is enough to renew all expiring contracts. The MPR rental preservation demonstration program would receive a slight increase to $20 million. Section 523 self-help housing would be cut by two-thirds. Section 514/516 farm labor housing and Section 504 home repair loans and grants would be cut by lesser amounts. Congressional appropriations subcommittees are holding hearings on the budget requests. HUD BUDGET PROPOSES CUTS FOR SOME, INCREASES FOR OTHERS. Funds would be reduced for CDBG, HOME, SHOP, and Section 811. The Housing Trust Fund would be funded at id=”mce_marker” billion. Increases are proposed for homelessness programs, rental assistance, the Public Housing Operating and Capital Funds, Section 202, Choice Neighborhoods, and housing counseling. VASH vouchers would be continued at $75 million. The budget requests $5 million to fund the new Rural Housing Stability Assistance Program. No funding is requested for the Rural Innovation Fund or its predecessor, the Rural Housing and Economic Development Program.

SENATE COMMITTEE HOLDS HEARING ON NATIVE AMERICAN HOUSING. “Identifying Barriers to Indian Housing Development and Finding Solutions” was convened on April 10 by the Senate Select Committee on Indian Affairs. A webcast and copies of witnesses’ written testimony are available online.

USDA OFFERS IRP FUNDS. Nonprofit and public intermediaries can apply for Intermediary Relending Program funds to provide loans to support rural businesses and community development groups. Deadlines are March 29 and June 28. Contact a USDA RD state office for application forms.

HUD SETS POLICY ON TENANT PROTECTION VOUCHERS. HUD Notice PIH 2013-08 tells owners of HUD-assisted properties to notify tenants by May 15 if they intend to apply for vouchers and to apply by June 14. Properties must be in low vacancy areas and their mortgages must have matured or use restrictions expired during FY12. HOMELESSNESS HAS DECREASED IN U.S. BUT INCREASED IN SOME STATES. The National Alliance to End Homelessness’s State of Homelessness in America 2013 report also says the number of people experiencing homelessness as part of a family increased slightly, while the numbers of chronically homelessness individuals and veterans decreased significantly. FAIR HOUSING ACT SHOULD BE MODERNIZED, NFHA SAYS. In its annual fair housing trends report, the National Fair Housing Alliance calls for adding sexual orientation, gender identity, source of income, and marital status to the Act’s protected classes. The data in Modernizing the Fair Housing Act for the 21st Century show that complaints of discrimination on these bases, as well as harassment complaints, have increased.

APRIL IS FAIR HOUSING MONTH. HUD has launched a national media campaign to educate people about the Fair Housing Act. To file a complaint visit HUD’s website or call 1-800-669-9777, or use HUD’s fair housing discrimination app for iPhone and iPad.

BUDGET RELEASE SET FOR APRIL 10. The Obama Administration’s budget for FY14 will be released April 10. HAC will post information and analyses at ruralhome.org as early as possible that day.

HUD OFFERS FUNDS FOR CHOICE NEIGHBORHOODS AND FAIR HOUSING PROGRAMS. PHAs, tribal entities, local governments, nonprofits, and for-profits applying with a public entity are eligible to apply for Choice Neighborhoods Planning grants by May 28; contact HUD staff, choiceneighborhoods@hud.gov. Eligibility for Fair Housing Initiatives Program funds varies by component; apply by June 11. Fair housing enforcement organizations and nonprofits can apply by April 22 for Fair Housing Organization Initiative Continuing Development funds. The contact for all the fair housing programs is Myron P. Newry, HUD, 202-402-7095.

RULES PROPOSED FOR RURAL HOUSING STABILITY ASSISTANCE PROGRAM. RHSP, a new HUD program, was authorized by the 2009 HEARTH Act to help address rural homelessness. The grants are intended for counties, who may designate nonprofits or local governments as applicants. The proposed rule would create a new definition of “rural.” It would also revise HUD’s definition of “chronically homeless.” Comments are due May 28. Contact Ann Marie Oliva, HUD, 202-708-4300.

USDA LIMITS POST-FORECLOSURE COLLECTIONS. After critical coverage by the Wall Street Journal and CBS News, RD has decided to stop collecting its losses from Section 502 direct and guaranteed borrowers who lose their homes to foreclosure. The agency will not drop collection efforts that have already begun, however, and will also pursue borrowers whom it believes have the resources to repay government losses. More details are provided in a press release from HAC and the National Housing Law Project and in a second Wall Street Journal article.

GUIDANCE ISSUED ON GRANDFATHERED RURAL DEFINITION. USDA RD issued Administrative Notice 4711 on March 28, explaining that community facilities, business, and utilities programs must apply 2010 Census data to area eligibility determinations as of March 27, but the final FY13 appropriations bill delays the change for housing programs until September 30 (see HAC News, 3/21/13). The housing programs will base area eligibility on pre-2010 Census determinations, including grandfathering, for applications that are complete by September 30, 2013 or filed in response to NOFAs published by September 30, 2013, provided that funds are obligated by December 31, 2013 or the agency administrator grants a waiver. METROPOLITAN AND MICROPOLITAN STATISTICAL AREAS REVISED. An Office of Management and Budget bulletin lists new area delineations. HAC’s initial analysis will be posted online soon.

DAILY YONDER SERIES CONSIDERS 50,000 POPULATION THRESHOLD FOR DEFINING RURAL. The online rural news site has published three commentaries examining USDA RD’s recent recommendation (see HAC News, 3/6/13) to increase the size of places eligible for its non-housing programs, and welcomes additional submissions.

TONSAGER LEAVING USDA. Under Secretary for Rural Development Dallas Tonsager has resigned. An official statement does not indicate his future plans.

ALL HUD OFFICES TO CLOSE FOR SEVEN DAYS. HUD has posted frequently asked questions on its sequestration information page, explaining that virtually all HUD staff will be furloughed and offices closed on seven days between May and August. The exact dates will be posted online when available.

SECTION 538 INDUSTRY FORUMS SCHEDULED. USDA will hold phone or web meetings about the guaranteed rental program in July and November. To receive announcements by email, contact Monica Cole, RD, 202-720-1251.

SEQUESTRATION COULD CUT 140,000 SECTION 8 VOUCHERS. A new Center on Budget and Policy Priorities paper, “Sequestration Could Deny Rental Assistance to 140,000 Families: Cuts Come at a Time of Rising Need for Housing Assistance and Will Exacerbate Homelessness,” notes that thousands of others could face rent increases. A CBPP blog post summarizing the report is also online.

INDIAN HOUSING DEVELOPMENT HANDBOOK UPDATED. The 2013 version of the National American Indian Housing Coalition’s guide covers planning, funding sources, homeownership strategies, and a summary of relevant Indian law.

CONGRESS SETS FINAL FY13 FUNDING, CONTINUES RURAL AREA ELIGIBILITY. On March 20 and 21 the Senate and House passed a final appropriations bill for the current fiscal year. Unlike a previous House version (see HAC News, 3/6/13), the final includes full spending bills for USDA and some other agencies, and specific provisions for some HUD programs. It retains the 5% sequester and adds a 2.5% across the board cut. It also retains current area eligibility for USDA rural housing programs through the end of FY13. President Obama is expected to sign the bill. [tdborder][/tdborder]

FY14 FUNDING PROCESS UNDERWAY. The Administration’s FY14 budget is expected to be released on April 8. The House Budget Committee has passed H.Con.Res. 25 and the Senate Budget Committee approved S.Con.Res. 8, resolutions that would set broad spending guidelines for FY14 appropriations. The two chambers are not expected to agree on a single budget resolution, so their FY14 appropriations bills will be based on different starting points.

REVISIONS PROPOSED IN CRA INTERAGENCY QUESTIONS AND ANSWERS. The federal banking regulatory agencies propose revisions and additions to the Q&A document intended to help lenders comply with the Community Reinvestment Act. Comments are due May 17. ContactBobbie K. Kennedy, OCC, 202-649–5470.

REUTERS CRITICIZES SECTION 502 GUARANTEE PROGRAM AND GRANDFATHERING OF AREA ELIGIBILITY. In “Special Report: A rural housing program city slickers just love” news agency Reuters claims that guaranteed loans have been made in urban places, to ineligible borrowers, and to purchase expensive homes. USDA’s response disputes some of the article’s claims and asserts that the agency operates the program in accordance with the law. HAC is preparing a response, which will be posted at www.ruralhome.org when available.

HOUSING COSTS REMAIN OUT OF REACH, NLIHC REPORTS. HAC’s summary of the National Low Income Housing Coalition’s annual Out of Reach report notes that, except for some counties in Oregon and Washington (where state minimum wages are higher than the federal minimum wage), there is no U.S. county where a one-bedroom rental at HUD’s Fair Market Rent is affordable to a minimum wage earner. RD EXPECTS PROGRAM CUTS BUT NO FURLOUGHS UNDER SEQUESTER. RD officials say they do not have authority to allocate cuts across programs, so funding for each loan or grant program will be reduced by 5%. (HAC apologizes for any confusion caused when the HAC News previously reported cuts would be 5.1%). Section 521 Rental Assistance contracts will be paid as long as possible; sometime in September, funding will run out for an estimated 10,340 RA contracts. RD estimates the resulting loss in project income could lead to loan delinquencies at 411 projects. RD also calculates the sequester will reduce FY13 aid by 294 Section 502 direct loans, 24 new Section 515 rental units, and 17 new Section 514/516 farm labor housing units, and will cut 568 jobs. The Section 538 and 502 guarantee programs will not be cut because they are funded by fees charged to program participants, but they could be impacted by factors such as staff cuts. HOUSE APPROVES GOVERNMENT FUNDING FOR FY13. On March 6 the House passed H.R. 933, a continuing resolution for the remainder of FY13. The bill keeps FY12 funding levels and the sequester in place for USDA, HUD, and other domestic discretionary programs, adds a 0.098% across the board cut, and reallocates some defense and veterans spending. Each housing program would receive 94.902% of its FY12 funding. The Senate has not yet released a proposed bill.

AREA ELIGIBILITY CHANGES STILL UNCERTAIN. USDA RD has not issued final determinations about changes in geographic eligibility for housing programs that are expected to take effect March 28 (see HAC News, 9/26/12). H.R. 933, the House CR (see item above), contains language that seems to be intended to maintain current eligibility status through September 30, 2013. RD officials say they are reviewing the language, which is not identical to wording in the current CR that funds the government through March 27. Rep. Jeff Fortenberry (R-NE) and others have introduced H.R. 858, which would retain current eligibility until 2020 Census data is available.

ASSETS FOR INDEPENDENCE DEADLINES APPROACH. Applications are dueMarch 25 and May 24. This programprovides five-year grants to nonprofits and government agencies that establish individual development accounts for low-income participants. Contact the AFI Resource Center, 1-866-778-6037.

BIPARTISAN HOUSING COMMISSION REPORT SUPPORTS RURAL HOUSING. On February 25 the Bipartisan Policy Center’s Housing Commission released its report, Housing America’s Future: A New Direction for a National Policy, making recommendations on mortgage finance reform and other issues including rural housing. It recommends keeping the rural housing programs at USDA, extending the current definition of eligible areas, increasing funding, and strengthening local nonprofit users of USDA funds. HUD REPORTS CONTINUED INCREASE IN WORST CASE HOUSING NEEDS. Worst Case Housing Needs 2011: A Summary Report to Congress shows that the number of unassisted very low-income renters with severe cost burden or severely substandard housing has increased by 19% since 2009 and 43% since 2007. The total number of renters has increased, renter incomes have declined, rents have increased, and the number of affordable rental units available to very low-income renters has decreased. A more detailed report is forthcoming.

NLIHC FINDINGS HIGHLIGHT HOUSING NEED FOR EXTREMELY LOW-INCOME RENTERS.Housing Spotlight: America’s Affordable Housing Shortage and How to End It reports that added affordable housing units have not kept pace with increases in extremely low-income renters (those with incomes below 30% of area median), resulting in a shortage of 4.6 million units. This calculation does not include people who are homeless.

USDA RD RECOMMENDS 50,000 POPULATION THRESHOLD FOR NON-HOUSING PROGRAMS.On February 22 USDA RD submitted a Report on the Definition of “Rural to the House and Senate Agriculture Committees. It recommends making the Rural Business, Rural Utilities, and Community Facilities programs available in places with up to 50,000 population. The report suggests that RD could use a number of factors such as population density and economic conditions to target funding to the most rural places and the places with the greatest need.

INDIAN HOUSING DEVELOPMENT HANDBOOK UPDATED. The handbook, published by the National American Indian Housing Council, has been updated to include provisions on implementation of the Helping Expedite and Advance Responsible Tribal Homeownership Act and revised BIA leasing regulations.

USDA AND HUD ESTIMATE SEQUESTRATION IMPACTS. In a letter to Senate Appropriations Committee Chair Barbara Mikulski (D-MD), USDA Secretary Tom Vilsack stated that if funding for the remainder of FY13 is cut on March 1 (see HAC News, 2/6/13), USDA will need to eliminate Rental Assistance for 10,000 households, not only making their homes unaffordable but also reducing funds available to owners for maintenance and mortgage payments. HUD Secretary Shaun Donovan testified before the committee on February 14, detailing numerous potential program cuts at HUD.

KEY CONGRESSIONAL COMMITTEES SET AGENDAS. HAC has posted a comparison of the action plans for the 113th Congress set by the congressional committees that have authority over housing programs. The House Financial Services Committee Oversight Plan mentions the impact of 2010 Census data on eligibility for USDA housing programs (see HAC News, 9/26/12). The House committee amended the plan as first proposed by Chairman Jeb Hensarling (R-TX), adding a paragraph on veterans housing and deleting language critical of NAHASDA and CDBG.

USDA ALLOWS MORE DEBT FOR ENERGY EFFICIENT HOMES. To replace the discontinued Rural Energy Plus program (see HAC News, 9/26/12) for Section 502 direct loans, an Unnumbered Letter dated February 14, 2013 tells agency staff that because energy efficiency lowers utility costs, it may be treated as a “compensating factor” that indicates a homebuyer can safely assume more debt than USDA’s standard amount. SECTION 523 GRANTEES TO BE FUNDED AT 40%, PENDING APPROPRIATIONS. Using funds carried over from FY12 and appropriated for FY13 through March 27, USDA will renew contracts of performing self-help grantees at 40% of the amount of their two-year contracts. New contract language will say each grantee may not start more than 40% of the units proposed for the first year of its contract until additional funds are appropriated.

CDFI BOND GUARANTEE PROGRAM IMPLEMENTED. An interim rule makes this new program effective on April 8, and the CDFI Fund will also accept comments until that date. The CDFI Fund will guarantee bonds issued by approved CDFIs to raise lending capital. Contact Lisa M. Jones, CDFI Fund, 202-653-0421.

HUD ISSUES FINAL FAIR HOUSING RULE ON DISCRIMINATORY EFFECTS. The regulation formalizes the standard and process for determining whether a practice had a discriminatory effect, regardless of whether there was an intent to discriminate. Contact Jeanine Worden, HUD, 202-402-5188.

REGULATORS SET FOUR FINAL RULES ON MORTGAGES, implementing provisions of the Dodd-Frank Act. The Consumer Financial Protection Bureau issued final regulations on mortgage servicing under RESPA and the Truth in Lending Act (contact Whitney Patross, CFPB, 202-435-7700) and on loan originator compensation and related requirements (contact Daniel C. Brown, CFPB, 202-435-7700). Other regulators joined CFPB to set a regulation that requires appraisals for higher-risk mortgages (contact Lorna Neill, Federal Reserve Board, 202-452-3667).

HUD PROPOSES SOME STREAMLINING FOR FHA SINGLE-FAMILY INSURANCE. FEBRUARY IS AFRICAN AMERICAN HISTORY MONTH. President Obama’s proclamation is posted online.

SERIES OF FEDERAL FUNDING DECISION POINTS LOOMS. March 1: Automatic, across-the-board spending cuts in discretionary domestic programs (5.1%) and defense will occur unless Congress acts to avert them. March date unknown: The Administration will release its FY14 budget proposal. March 27: The continuing resolution that has provided FY13 funding ends and the government will shut down unless Congress takes action. April 15: Legislators’ salaries will begin to be escrowed as required by the debt ceiling increase bill signed into law by President Obama on February 4, unless/until Congress passes a concurrent budget resolution for FY14. A budget resolution is not binding, so the appropriations committees can begin considering FY14 funding bills without it. May 18/August date unknown: The debt ceiling is suspended through May 18 and then it increases by a formula that is expected to enable the federal government to continue meeting its debts until sometime in August.

SENATE COMMITTEE REQUESTS INPUT ON ITS BUDGET RESOLUTION. Senate Budget Committee chair Patty Murray (D-WA) invites comments and suggestions online.

HURRICANE SANDY FUNDS APPROVED. On January 29 President Obama signed into law a $50.5 billion supplemental appropriations bill that includes $16 billion in disaster CDBG funding for jurisdictions impacted by Hurricane Sandy or any other presidentially declared disaster in 2011, 2012, or 2013.

HUD OFFERS GRANTS FOR NATIVE AMERICAN CONSTRUCTION RESEARCH. Tribes, nonprofits, foundations, and institutions of higher education can apply by March 25 for the Transformation Initiative: Sustainable Construction in Indian Country Small Grant Program. Contact Mike Blanford, HUD, 202-402-5728.

USDA EXPANDS SECTION 502 REFINANCE PILOT. Fifteen states and Puerto Rico are added to the original 19 states (see HAC News, 2/8/12) where Section 502 direct and guaranteed borrowers who are current on payments can refinance to guaranteed loans with lower interest rates. RD ADDRESSES SERVICING FOR 515 BORROWERS WHO RECEIVED DAMAGES. A UL reminds field staff that owners who received damages after settling prepayment litigation are not eligible for incentives or for prepayment.

CFPB SEEKS COMMENTS ON ABILITY-TO-PAY RULES. Comments are due February 25 on Consumer Financial Protection Bureau amendments to its ability-to-pay/qualified mortgage regulation (see HAC News, 1/23/13). Possible changes include exemptions for nonprofits, HFAs, and NFP grantees, and qualified mortgage status for small lenders. HAC will try to make its comments available before the deadline. CFPB EXPANDS HOEPA COVERAGE AND HOUSING COUNSELING REQUIREMENT. A final rule expands the types of high cost mortgage loans that are subject to the Home Ownership and Equity Protections Act; imposes new requirements on HOEPA-covered mortgages, including a pre-loan counseling requirement; and exempts reverse mortgages (which were previously exempt), initial construction loans, loans originated and financed by housing finance agencies, and USDA Section 502 direct loans. CFPB REQUIRES COPIES OF APPRAISALS. Another final rule implements a requirement for lenders to provide applicants with copies of appraisals in connection with applications for first lien mortgages, rather than providing copies only when applicants request them. HUD REQUESTS IDEAS ON AHS CHANGES. HUD seeks input by April 2 on concerns related to redesigning the American Housing Survey sample, content that should be added or dropped, and ideas for data dissemination. 44% OF U.S. HOUSEHOLDS ARE “LIQUID ASSET POOR” and 26% are “net worth asset poor.” The Corporation for Enterprise Development’s 2013 Assets and Opportunities Scorecard reports that most of these low-asset households have below-poverty level incomes, and a disproportionate number are minorities. OMB tells agencies to plan for sequester, CBPP reports smaller cuts. A memo from the Office of Management and Budget advises federal agencies to intensify planning for possible sequestration, but not to take action yet. Unless Congress changes the law, federal funding will be cut on March 1. The Center on Budget and Policy Priorities calculates that because of changes made in the tax deal (see HAC News, 1/10/13) the cut for non-defense discretionary programs including housing will be 5.1% rather than the previously expected 8.2%.

Administration’s FY14 budget will be late. OMB informed House Budget Committee Chair Paul Ryan on January 11 that delays in congressional action on the “fiscal cliff” delayed the Administration’s FY14 budget preparations and the budget will be submitted after the February 4 due date. OMB does not give a specific release date.

Congressional leadership changes still in process. In the 113th Congress, Sen. Barbara Mikulski (D-MD) is the new chair of Senate Appropriations. For House Appropriations, Rep. Ed Pastor (D-AZ) is the new ranking member (top Democrat) on the Transportation-HUD Subcommittee. Rep. Sam Farr (D-CA) continues as ranking member on the Agriculture Appropriations Subcommittee. The new chair of the Senate Agriculture Appropriations Subcommittee has not yet been announced, nor have the top Senate Republicans on both Appropriations and Banking. All committees also have some new members, as in any new Congress.

Secretaries Vilsack and Donovan to remain in new Administration. Tom Vilsack will continue to serve as Secretary of Agriculture and Shaun Donovan as Secretary of Housing and Urban Development.

Some rural mortgages exempt from new escrow rule. Effective June 1, the Consumer Financial Protection Bureau will require private mortgage lenders to maintain escrow accounts for “higher-priced” loans for five years rather than one year. Small portfolio lenders that serve primarily rural or underserved areas and do not escrow for other mortgages are exempt. “Rural” is defined on a county basis: “a county is rural if it is neither in a metropolitan statistical area nor in a micropolitan statistical area that is adjacent to a metropolitan statistical area.” CFBP will publish a list of these counties. New poverty guidelines released. The Department of Health and Human Services has adjusted its poverty guidelines to account for a 2.1% increase in the cost of living from 2011 to 2012. For programs that use this benchmark, the 2013 poverty line for a family of four in the continental U.S. is $23,550.

HUD compiles environmental training webinars. Online sessions from 2011 and 2012 covering a variety of topics related to environmental reviews are at www.onecpd.info/learning-center/environmental-review-training/.

Many Blacks and Latinos would be impacted by sequestration. A study by the Center for Social Inclusion found higher numbers (not percentages) of Blacks and Latinos than Whites will be impacted if sequestration goes into effect. Based on program funding cuts of 8.2% (not the 5.1% currently estimated by CBPP; see first item in this HAC News) to non-defense discretionary programs, about 115,000 Black and Latino individuals would lose HUD tenant-based vouchers, 90,000 would lose homelessness assistance, and almost 850,000 would lose LIHEAP home energy aid. Falling Off the Fiscal Cliff? Race, Opportunity and Sequestration also includes data for a few individual states.

Smart Growth America supports reexamination of priorities. Federal Involvement in Real Estate: A Call for Examination reports that in 2008 federal housing spending (direct and through taxes) averaged $6,253 for households with incomes of $200,000 and above, $254 for those with incomes in the $30,000-40,000 range, and $833 for those with incomes under id=”mce_marker”0,000. It also notes that 84% of federal real estate funding supports home-ownership while 35% of households are renters. SGA suggests that federal policy be targeted to support balanced housing choices; reinvest in existing places and properties; provide a safety net; and help more Americans reach the middle class.

HAC blog post tackles Native American homelessness. Based on a forthcoming guide from HAC and the Corporation for Supportive Housing, “Counting Better: A Step Toward Addressing Native American Homelessness” recommends local counts of homeless people on Native lands to document the need for assistance.

TAX DEAL DELAYS SEQUESTRATION. The American Taxpayer Relief Act of 2012, the deal reached by the Administration and Congress to avoid the “fiscal cliff,” delays until March 1 the 8.2% across-the-board spending cuts that would have been effective January 1 (see HAC News, 9/26/12), while lowering the caps for FY13 discretionary spending. It also extends for one year a 9% credit floor for Low Income Housing Tax Credit deals and extends the New Markets Tax Credit for 2012 and 2013. In February and March Congress will be faced with decisions about sequestration, the U.S. debt ceiling, and the continuing resolution for FY13 funding that expires on March 27.

USDA OFFERS MPR PRESERVATION FUNDS. Pre-applications for the Multi-Family Housing Preservation and Revitalization Demonstration Program for Sections 515 and 514/516 are due February 28. Unfunded applications from previous years will receive priority. No new Rental Assistance is available. The notice and pre-application form are available in the Federal Register and on RD’s website. ROSS SERVICE COORDINATORS APPLICATIONS INVITED.Nonprofits, PHAs, tribes/TDHEs, and resident associations can apply by February 19 for Resident Opportunity and Self-Sufficiency Service Coordinator funding. FUNDS AVAILABLE FOR CDFIS. Community Development Financial Institutions and Native CDFIs can apply by February 28 for financial or technical assistance monies from the CDFI Fund, subject to appropriations. Contact agency staff, 202-653-0421.

CFPB CHANGES “QUALIFIED RESIDENTIAL MORTGAGE” DEFINITION. A regulation proposed in May 2011, intended to ensure that consumers receive mortgages they can repay, would have strongly discouraged non-governmental mortgages with downpayments under 20%. The final rule, announced on January 10, drops the downpayment standard and uses instead a 43% debt-to-income ratio, along with numerous other requirements. Some balloon payment mortgages would be allowed if made by small creditors in rural and underserved areas. CFPB requests comment on some amendments, including one to define as QRMs all mortgages made and held in portfolio by small creditors. The comment deadline will be set when the rule is published in the Federal Register.

USDA RD PROPOSES CIVIL MONEY PENALTIES. Comments are due February 4 on a proposed rule intended to create more effective civil monetary penalties, along with due process protections, for violations of housing program statutes, regulations, and loan documents. COMMENTS SOUGHT ON SECTION 202 PRESERVATION RENTAL AID. Comments are due March 11 on proposed 20-year Senior Preservation Rental Assistance Contracts that would prevent displacement when Section 202 properties are refinanced or recapitalized. Contact Margaret Salazar, HUD, 202-708-2495.

FARMWORKER HOUSING RA BEING MONITORED. An Unnumbered Letter issued December 13, 2012 explains that USDA is monitoring transfer of Section 521 Rental Assistance from Section 514/516 Farm Labor Housing properties to ensure RA is transferred to other FLH properties when possible, in compliance with the continuing resolution that funds the program through March 27. NEW GUIDE EXPLAINS HOW TO COMBINE HOME AND LIHTC. HOME and the Low-Income Housing Tax Credit Guidebook, published by HUD, addresses compliance with the requirements of both programs.

HUD DESCRIBES NEW FAIR HOUSING ASSESSMENT AND PLANNING PROCESS. In its Statement of Regulatory Priorities for FY13, HUD says it plans to issue a proposed rule in April changing how it administers its obligation to affirmatively further fair housing. It will replace the existing analysis of impediments requirement with a fair housing assessment and planning process, hoping to create a more direct link between fair housing and Consolidated Plans or PHA Plans. REPORT DESCRIBES SUCCESSES OF SECTION 502 DIRECT AND SECTION 523 SELF-HELP. A new National Rural Housing Coalition publication shows how these programs have expanded homeownership opportunities to some of the nation’s poorest rural families at little expense to the federal government. HAC BLOG POSTS COVER DATA, REVIEW 2012. In December HAC contributed two posts to Shelterforce magazine’s Rooflines blog. “Basic Challenges Outlast Housing Crisis in Rural America” presents some key findings from HAC’s Taking Stock report. “10 Things That Did Not Happen in Rural Housing in 2012” lists several things that should have happened but did not, and also observes that housing advocates did not give up.
