The Uniform Relocation Assistance and Real Property Acquisition Policies Act Final Rule has been published

Satellite Broadcast – Uniform Act Final Rule Implementation (posted 2/4/05)

On February 24, from 11am-5pm Eastern, HUD will broadcast a joint HUD/FHWA session providing an overview and guidance on implementation of the Uniform Act Final Rule (49 CFR Part 24). Background Information:

On January 4, 2005, the Federal Highway Administration as lead Federal Agency for the Uniform Relocation Assistance and Real Property Acquisition Policies Act (Uniform Act or URA), published a final rule in the Federal Register revising the government-wide regulations implementing the Uniform Act under 49 CFR Part 24. The Uniform Act applies to the acquisition of real property and the displacement of persons resulting from Federal or federally-assisted programs or projects. The Uniform Act affects 18 Federal Agencies including HUD.

The Effective Date Of The Final Rule Is: February 3, 2005
HUD grantees and Participating Jurisdictions (PJs) must ensure their program and project activities are in compliance with the final rule as of this date.

Here are just a few of the many changes made:

  • No Waivers Of Relocation Assistance
  • One Year Limit On Temporary Relocation
  • New Income Standard To Determine Base Monthly Rental For Replacement Dwelling

HUD is currently in the process of updating existing publications and resources affected by the final rule, including HUD’s Handbook 1378 – Tenant Assistance Relocation and Real Property Acquisition. HUD grantees and PJs should exercise caution when using electronic and printed material impacted by the final rule until such time as the required revisions are completed.
